Germany – Immigration Program

Introduction

  • German immigration policy promotes a path to securing long term residency for applicants who fulfil a set criteria.
  • Immigration is possible either on the ground of economical independence or by establishment / acquisition of a business in Germany.
  • The Immigration Program facilitates non-EEA nationals and their families who commit to an approved investment in Germany to acquire a secure residency status in Germany.
  • Any non-EEA national may apply for residency for themselves and their spouse / partner and children under the age of 18.

Overview of the Program

There are no limits for stay and travel in Germany and other Schengen-Treaty states and no requirements on knowledge of the German language.

  • Step 1 – Make an application without committing any investment funding.
  • Step 2 – Receive Approval of entry permit (entry visa).
  • Step 3 – Entry and registration.
  • Step 4 – Execution of the Stay Permit.

      Stay Permit:

      • is granted for 1 year;
      • extended twice for 2 years in Germany (makes 5 years in total).

  • Step 5 – After 5 years of residence in Germany a Permanent Residence Permit can be granted.
  •  
      Permanent Residence Permit:

      A holder of a Permanent Residence Permit has all rights of a German citizen, except for participation in elections and visa regulations with the non-Schengen Treaty states.

      The additional conditions for applying in comparison with a regular Stay Permit are the following:


      • holding the Residence Permit for 5 or more years;
      • holding a German language certificate.

  • Step 6 – After 2 more years (7 years in total) it is possible to apply for the German citizenship.

      German citizenship:

      • private medical insurance is mandatory;
      • assumed that the focus of the applicant’s life will be moved to Germany and the most time will be spent in the Schengen-Treaty zone. Although this is not a strict condition for the first Residence Permit extension.

Financial Independence

No investments in a company or property required!

There are no strictly determined requirements, each application is reviewed individually.

Based on our experience and practice, we can identify the key criteria and conditions for the positive outcome:

  • possession of assets above € 1 million for each family member (real estate, liquid assets, business, etc.);
  • monthly income of € 4-5 thousand for each family member.

Depending on the number of family members the requirements may be lower. The assets may be presented as a confirmation of the applicant’s financial independence regardless of their location.

Business

  • The condition for the residence permit is a confirmation of the prospects of the proposed activities by the applicant.
  • After the 01.08.2012 amendment to § 21 of the German Residence Act (AufenthG), foreigners wishing to start business in Germany are no longer required to prove the particular importance of their enterprise for the chosen region, to invest € 250,000 and hire 5 or more employees. Each application is reviewed individually.
